By purchasing this mindful presence online course, you agree to the following terms and conditions:
1. Course Enrollment and Payment1.1 Enrollment: Your enrollment in the Course is confirmed once full payment is received. Access to the Course materials and the 1-1 sessions will only be provided after payment has been processed.
1. Payment: All fees are in pound sterling. Payment must be made through our approved payment methods, and your access to the Course is contingent upon the successful processing of payment.
2. Course Schedule and Availability
2.1 Session Scheduling: Upon enrollment, you will receive instructions for scheduling your 1-1 sessions. Sessions will be held at mutually agreed-upon times. All sessions will take place via a mutually agreed platform [Zoom, MSteams, or other platform] .
2.2 Rescheduling and Cancellations: If you need to reschedule a session, you must provide at least 48 hours’ notice. If you fail to attend a session or provide less than 48 hours' notice, the session will be forfeited, and no refund will be issued.
2.3 Missed Sessions: If you miss a session without prior notice, we reserve the right to cancel or charge for the session. We will not reschedule sessions for missed appointments unless there are exceptional circumstances.
2.4 Course Duration: The duration and number of 1-1 sessions included in the Course will be clearly outlined at the time of purchase. You must complete all sessions within six months from the date of purchase, unless otherwise agreed upon.
3. Refunds and Cancellation Policy
3.1 Refund Policy: Due to the personalized nature of the Course, refunds are not provided after the first session. However, if you wish to cancel your enrollment before the first session, you may receive a full refund within 5 days of purchase. After the first session, no refunds will be issued.
3.2 Course Cancellation by Us: If we need to cancel or reschedule a session due to unforeseen circumstances, we will offer you an alternative session at a mutually agreed time. If we are unable to reschedule, you may be entitled to a partial refund for the missed session(s).
4. Intellectual Property
4.1 Course Materials: All Course materials provided, including but not limited to videos, worksheets, templates, and written content, are owned by Dean Elliott and are protected by copyright. You agree not to reproduce, distribute, or use the materials for commercial purposes without explicit permission.
4.2 Recording Sessions: With prior consent, we may record your 1-1 sessions for educational or promotional purposes. You will be notified if a session is being recorded, and you may opt out of the recording if desired.
5. Confidentiality and Privacy
5.1 Confidentiality: Both parties agree to keep any personal information shared during the Course confidential, unless required by law. This includes personal details, business information, or any other sensitive information shared during sessions.
5.2 Data Protection: Your personal data will be collected, processed, and stored in accordance with the UK Data protection act 2018 (UK GDPR). By purchasing the Course, you consent to the use of your data as outlined in our Privacy Policy.
6. User Responsibilities
6.1 Engagement and Commitment: You agree to actively participate in the Course. The effectiveness of the Course is dependent on your engagement, and you are solely responsible for your progress.
6.2 Communication: You agree to communicate in a respectful manner and follow the agreed-upon communication methods for any questions or feedback. Disrespectful or inappropriate behaviour and/or language may result in termination of the Course without a refund.
7. Limitation of Liability
7.1 No Guarantee of Results: While we strive to provide valuable educational content, we do not guarantee specific outcomes, success, or results from participating in the Course. Individual results may vary.
7.2 Limitation of Liability: To the fullest extent permitted by law, Mindful Presence/Dean Elliott and its affiliates shall not be liable for any indirect, incidental, or consequential damages arising from your participation in the Course.
8. Changes to Terms and Conditions
8.1 Modifications: We reserve the right to update or modify these Terms and Conditions at any time. Any changes will be communicated to you, and your continued participation in the Course will constitute acceptance of the updated terms.
9. Governing Law and Dispute Resolution
9.1 Governing Law: These Terms and Conditions are governed by UK legislation. Any disputes arising from these terms shall be resolved in accordance with UK legislation.
9.2 Dispute Resolution: In the event of a dispute, you agree to attempt to resolve the issue informally through communication with Mindful presence/Dean Elliott. If resolution is not possible, disputes may be resolved through mediation or arbitration, as agreed upon by both parties.
